1. About These Terms

These Terms of Service (“Terms”) govern your use of the Messaging Pro application and services (“Service”), operated by TekSpert LTD.

By accessing or using Messaging Pro, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 16 years of age to use Messaging Pro. By creating an account, you confirm that you meet this requirement and that the information you provide is accurate and complete.

3. Your Account

  • You are responsible for maintaining the security of your account credentials.
  • You must not share your account with others or allow unauthorised access.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately if you suspect unauthorised use of your account.

4. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or bulk communications.
  • Harass, threaten, abuse, or harm other users.
  • Distribute malware, viruses, or other harmful software.
  • Share illegal content, including but not limited to child sexual abuse material.
  • Impersonate another person or entity.
  • Attempt to circumvent security measures, access other users' accounts, or interfere with the Service's infrastructure.
  • Use the Service for any purpose that violates applicable UK law or regulations.

We reserve the right to suspend or terminate your account if you breach these terms, without prior notice.

5. End-to-End Encryption

Messaging Pro provides end-to-end encryption using AES-256-GCM. You acknowledge that:

  • We cannot access, read, or recover the content of your encrypted messages.
  • If you lose your encryption keys (e.g., by uninstalling the app without backup), your messages cannot be recovered.
  • You are solely responsible for the security of your device and encryption keys.
  • Encryption does not prevent recipients from sharing or forwarding your messages.

6. Content You Share

You retain ownership of all content you share through the Service. By using the Service, you grant us a limited, non-exclusive licence to transmit, store (in encrypted form), and deliver your content as necessary to provide the Service.

You are solely responsible for the content you share. You must not share content that infringes on the intellectual property rights of others.

7. Service Availability

We aim to provide the Service 24/7 but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will endeavour to provide advance notice of planned maintenance where possible.

8. Intellectual Property

The Messaging Pro name, logo, and all related branding, software, and documentation are the intellectual property of TekSpert LTD. You may not reproduce, modify, distribute, or create derivative works from our intellectual property without our express written consent.

9. Limitation of Liability

To the fullest extent permitted by law:

  • The Service is provided “as is” without warranties of any kind, whether express or implied.
  • TekSpert LTD shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service.
  • Our total liability to you shall not exceed the amount you have paid us in the 12 months preceding the claim (if any).
  • Nothing in these Terms excludes liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

10. Termination

You may delete your account at any time through the app settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

We may suspend or terminate your account if you breach these Terms, engage in illegal activity, or if we are required to do so by law. We will provide notice where reasonably practicable.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
